He stayed in the marriage for their two sons, but has now filed in court &#8212; not for divorce, but to demand the state\u2019s criminal anti-adultery law be enforced.<\/p>\n<p>It took Banks \u201cyears\u201d to convince police to file charges.  \u201cIf they used it all the time, maybe women or men would think twice about going and jumping in the sack and throwing away their marriage,\u201d he said.  His wife, Traci, admits to two affairs, and says they have not been living together, but they are still legally married because she can\u2019t afford to file for a divorce.<\/p>\n<p>Detectives have told Banks that prosecutors will not likely pursue a conviction.  \u201cHow do they get to pick and choose which laws they can and can\u2019t enforce?\u201d  Banks complains.  \u201cThey got somebody readily admitting guilt.
